وقف النقود والأوراق المالية-تجربة المملكة الأردنية الهاشمية نموذجا
Abstract
ملخص
هدفت هذه الدراسة لعرض آراء الفقهاء في وقف النقود والأوراق المالية وما يتصل بها من مسائل كوقف المنقول والمشاع والمشترك والمؤقت، ثم بينت الأغراض المباشرة وغير المباشرة لهذه الأوقاف, ثم عرضت أهم الصور المعاصرة لهذا النوع من الأوقاف، وختمت الدراسة بالحديث عن تجربة المملكة الأردنية الهاشمية في هذا المجال، وذلك من خلال بيان موقف التشريعات القانونية ورأي دائرة الإفتاء العام، ومن ثم تقديم ثلاثة نماذج من الواقع التطبيقي. وخلصت الدراسة إلى أن فريقا من العلماء القدامى، يرى جواز وقف النقود, في حين يتفق المعاصرون، على جواز وقف النقود والأوراق المالية. وأن هناك صوراً معاصرة لهذا النوع من الوقف. وأن لدى الأردن تجربة متواضعة في هذا المجال، ووتوصي الدراسة بضرورة إيجاد السبل اللازمة لتعزيز الثقافة بهذا النوع من الأوقاف والحث عليه. وإنشاء صندوق وطني لوقف النقود والأوراق المالية يهدف لإعمار العقارات الوقفية، ويلبي حاجات المجتمع.
Waqf Money and Financial Papers-Experience of the Hashemite Kingdom of Jordan as a Model
Abstract
The aim of this study is to present the views of jurists on waqf money and Financial papers and related issues such as waqf the movable and the common and the joint, and the interim, Then explained the direct and indirect purposes of these waqf. The study then presents the most important contemporary types of this kind of waqf. The study concluded by talking about the experience of the Hashemite Kingdom of Jordan in this field, through a statement of the position of the legal legislation and the opinion of the Department of Al'iifta. And then exhibit three models of applied reality. The study found that a team of previous jurists, who believe that money can be waqf, while collecting contemporaries agree on allowingwaqf money and Financial papers. And that there are contemporary forms of this kind of waqf, Jordan has a modest experience in this area. The study recommends finding ways to promote and encourage culture in this type of waqf, and establishing a national fund to waqf money and Financial papers aiming at the reconstruction of Waqf real estates to response society needs.
